KATHMANDU, July 23: The Supreme Court has ordered Commission for Investigation of Abuse of Authority (CIAA) to present dossier for hearing on the writ petition filed against the alleged illegal detention of Director General of Inland Revenue Department Chudamani Sharma from the Special court.

An extended full bench of Justices Dipak Raj Joshi, Dipak Kumar Karki, Kedar Prasad Chalise, Sharada Prasad Ghimire and Anil Kumar Sinha issued the order in response to the habeas corpus writ filed by Sharma’s spouse Kalpana Upreti on July 11, according to co-spokesperson of the court Biswaraj Poudel.

A decision was also reached to seek the dossier of the related case underway at the special court.

A joint bench of Justices Cholendra Shumsher JB Rana and Prakash Raut on June 18 had issued an order to keep the case at the Special Court in status quo, and send it to a full bench.

Sharma is presently under judicial custody while a case of corruption against him is being tried at the Special court.

CIAA filed case against Sharma and two other officials-Lumba Dhwoj Mahat, the chairman of the Tax Settlement Commission and Umesh Dhakal, a member of the commission at the Special court last week claiming that the trio embezzled 10.96 billion rupees from state fund.

A team of CIAA on June 3 had arrested Sharma on charge of misappropriating revenue and settling taxes while Mahat and Dhakal are still at large.

KATHMANDU, July 16: Commission for Investigation of Abuse of Authority (CIAA) has registered a corruption case against suspended Director General of Inland Revenue Department, Chudamani Sharma and two other officials of Tax Settlement Commission (TSC) on Sunday.

The other two are Lumba Dhwoj Mahat, the chairman of the Tax Settlement Commission and Umesh Dhakal, a member of the commission.

The anti-corruption body has claimed that the trio embezzled more than 10 billion from the state treasury and asked for 10 years jail terms for the trio.

Sharma, who was also the member secretary of the commission, was arrested on June 2 on charge of swindling the state fund. Mahat and Dhakal are absconding.

KATHMANDU, June 29: The Commission for the Investigation of Abuse of Authority (CIAA) has demanded Rs 3 billion each in bail from Director General (DG) of Inland Revenue Department Chudamani Sharma and two others for their alleged involvement in tax evasion.

According to the CIAA, the amount in bail was demanded from the three if they wish to release on general date. The CIAA has concluded that over 1,000 documents should be studied in regard to the tax exemption allowed by the then Commission on Tax Clearance.

The CIAA has also asked the bail amount with then chair of the Commission Lumbadhowj Mahat and Umesh Dhakal. Furthermore, the CIAA has urged the common people to inform about Mahat and Dhakal, saying that both of them are at large.

The CIAA had arrested Sharma on June 2.

Sharma is charged of clearing the tax amount of more than Rs 20 billion to different commercial firms and institutions.
“The bail amount was asked based on the study completed so far. Per head Rs 3 billion was demanded from them as a total of Rs 9 billion is confirmed to have been exempted deliberately,” a high level official of the CIAA said. RSS
