KATHMANDU, Aug 4: Nepal Bar Association (NBA) has said it is stunned over the rejection of Acting Chief Justice Deepak Raj Joshi by the Parliamentary Hearing Committee from becoming Chief Justice.

The PHSC mocked the rule of law by disapproving the name of Joshi by two-thirds majority, reads a press release issued on Friday by NBA General Secretary, Khamma Bahadur Khati.

The PHC’s decision was the direct intervention on judiciary and it was planned attack on it, according to the NBA.

Meanwhile, Democratic Lawyers Association (DLA) Nepal has blamed the ruling parties for not approving proposed CJ Joshi with an intention of keeping judges under the control of executive body.

A press release issued by DLA Nepal accused the ruling parties of taking such decision on the basis of revenge without carrying out necessary investigation on Joshi. RSS

KATHMANDU, May 25: The intellectual circle affiliated to opposition Nepali Congress has said that the NC could move ahead after following its principles and forwarding the youth friendly program even after amending its statute.

Speaking at a program organized by Ganesh Man Singh and Janaandolan Sahid Smriti Shanti Pratisthan, the speakers have opined that the party should correct its mistakes and adopt new policy and program targeting to youths.

NC leader Krishna Prasad Sitaula opined for changing the organizational structures and traditional thinking. The party should unite all democratic forces, he furthered.

NC lawmaker Bhimsen Das Pradhan said that the leaders and cadres should critically analyze its activities adding that the strongest force in the past has become weaker these days.

Similarly, former Vice Chancellor of Pokhara University Khagendra Bhattarai said that the democratic thought was winning the battle despite the party’s defeat in the elections.

Nepal Bar Association former chair Prem Bahadur Khadka said that the left forces united due to the activities of NC itself.

Democratic Lawyers Association former chair Gopal Krishna Ghimire and Engineer Association Nepal former chair Dhruba Thapa among other also focused on NC’s reform for better result. RSS

NEPALGUNJ, March 23: President Bidya Devi Bhandari has said all Nepalis should be one on securing the national goal of economic prosperity together with political stability further building on the historic political achievements.

Inaugurating the All Nepal Law Professionals National Conference organized by Nepal Bar Association here today, President Bhandari said the Association has played a laudable role in the country’s democratization process.

“The law professionals need to play more crucial role in constitution’s implementation, increasing citizen’s access to justice and achieving political stability to keep on safeguarding the historic achievement of constitution formulation in the contemporary world political scenario,” the Head-of-the-State said.

She said the latest events that have taken place in the judicial sector are of serious nature and the conference’s attention should be drawn towards this. The role of the law professionals in further strengthening the judiciary’s traditional image would be important.
Noting that the judiciary’s power was the public trust, President Bhandari said all sides should work towards enhancing the international prestige of Nepal’s judiciary through uniformity in the interpretation of the constitution and the law.

The President also said that the law professionals should play the role of facilitators in the enforcement of laws. “The law professionals should seek their role in accordance with the spirit and principle of ‘Let a hundred guilty be acquitted, but one innocent should not be convicted’,” the President stressed.

Chief Minister of Province No. 5, Shankar Pokhrel said that the Association should establish itself as an advocate of the rule of law.

Former parliament speaker Subas Chandra Nembang said the interference of none would ever be acceptable on the Constitution of Nepal. “We will amend the constitution as per the spirit of the Nepali people and the call of time,” he added.

NBA president Sher Bahadur KC presided over the inaugural program which was also addressed by Acting Chief Justice Deepak Raj Joshi, Attorney General Agni Prasad Kharel, federal and provincial lawmakers, and the Association’s central vice-president Shalikram Sapkota and general secretary Khamba Bahadur Khati, among the distinguished persons.
On the occasion NBA president KC presented souvenir to the President, the Chief Minister and the former House Speaker.

Papers on 10 different topics would be presented and discussed in the conference that will conclude on Sunday. The conference is also scheduled to issue the Nepalgunj Declaration’.
Three thousand law professionals from across the country are taking part in the conference. RSS

KATHMANDU, Jan 12: The Nepal Bar Association (NBA) has drawn its attention on the activities of Dr Govinda KC of blaming the judiciary and using unethical terminologies targeting the particular justice.

The meeting of the NBA Friday concluded that such activities of Dr KC were defaming the public respect to a free and accountable judiciary.

The press statement issued by the NBA General Secretary Khamba Bahadur Khati has stated that a wrong trend could exist if such activities continued.

The trend of staging on hunger strike, demanding resignation of justices if the court decision failed to favour someone’s vested interest was wrong, press statement reads.

There are legal institutions to ensure legal remedies if required therefore, undue pressure to the judiciary was against the spirit of law, the press statement reads further.

The NBA has urged Dr KC to withdraw his decision of continuing hunger strike. RSS

KATHMANDU: Vice-president of Nepal Bar Association (NBA) Tika Ram Bhattarai has warned of boycotting the bench of the Supreme Court (SC) if Chief Justice Khil Raj Regmi takes the charge of election government.

The NBA would lonely protest the CJ’s appointment to the prime minister though the parties agree on the CJ-led government, he claimed.

Club’s Chairman Rishi Dhamala presided over the program.

Speaking at an interaction program organized by the Reporters Club on Thursday, Bhattarai said, “We will leave no stone unturned including boycotting the bench of the SC. We will fight no matter the NBA is single in this issue.”

Bhattarai was of the opinion that the proposal to make the CJ new prime minister was floated not to hold the fresh CA elections to end the country’s deadlock but to sabotage the judiciary and its independence.

However, former President of the NBA Bishow Kanta Mainali, however, defended the CJ-led government. “The NBA can do nothing if the CJ-led election government is formed,” he said.

The legal practitioners should feel pride as the political parties have sought help from judiciary to resolve the country’s political and constitutional deadlock, he added.

 

Senior advocate Purna Man Shakya also asked the legal practitioners not to protest the CJ-led government as it was the last mantra to end the ongoing political deadlock in the country.

 

Also speaking at the same program, constitutionalist Dr Bhimarjun Acharya and legal practitioner Sher Bahadur KC also came heavily down on parties’ decision to form the CJ-led government.

KATHMANDU: The office bearers of the Nepal Bar Association (NBA) which is against the CJ-led government today met with the Chief Justice Khilaraj Regmi and suggested the later not to led the election government despite the political consensus for the same.

The meeting between the CJ Regmi and NBA office bearers is taken seriously as the political parties are learned to have agreed on the CJ-led government to hold the fresh CA polls within three months.

The newly-elected President of the NBA Hari Krishna Karki and other members of the NBA had reached the CJ’s office.
However, the CJ refused to share anything and talk about such government with the NBA members, it is said.

Karki, a candidate from the Progressive Republican group, presided the hot seat by defeating his nearest rival Sher Bahadur KC from the Democratic camp.

Though Surendra Thapa Magar was also in the race from Indigenous nationalities he was overpowered by both of his rivals and failed to make any noticeable impressions.

Similarly, the Sunil Kumar Pokhrel from the Democratic group has been elected as the general secretary.

Along with thatJanak Pandey Tikaram Bhattarai, Anita Gurung, Padam Prasad Baudhik, and Rajendra Saudh have been elected as Vice Chairpersons for eastern, central, western and far-western regions.

While democrat Mohan Ingam became the treasurer of the new committee, Shankar Timila, Ganesh Prasad Adhikari, Sagar Bista Prasanna Das from progressive group and Laxmi Rawal, Sarswati Shrestha and Rajya Laxmi Bajracharya from democratic panel have been elected to the NBA executive committee as members.
