KATHMANDU, Feb 10: Prof Dr Govinda KC has said he would keep on fighting for responsible judiciary under any circumstances.

Dr KC, the senior orthopedic surgeon at the Tribhuvan University Teaching Hospital (TUTH), is a familiar face in Nepali media who has been long advocating for reforms in medical sector and recently the ‘purification of judiciary’ has been added to his agenda.

At a press meet at the TUTH on Saturday, the senior surgeon who was of late charged with contempt of court and faced a trial for the same said his struggle for true justice from the judiciary would not stop no matter even all his property is confiscated for that.

“My battle is not against judiciary at all, rather it is intended at those who are exchanging justice for the sake of money from there,” he said.

It may be noted that the contempt of court charge filed against him for seeking resignation of incumbent Chief Justice Gopal Parajuli is subjudice at the Supreme Court.

At the press meet, he reiterated that the chief justice should immediately resign from the post to pave the way for fair investigation into the case.

The SC decision on January 7 to reinstate the dean of four years ago at the Institute of Medicine (IoM) , prompted Dr KC who has a huge public support for his moves to start his 14th fast-onto-death demanding the CJ’s resignation and inquiry into his activities. According to him, the decision to reinstate the IoM dean of four years back was not justifiable.

On the evening of January 8, he was arrested by the police and had spent two days in police custody.

Following a hearing for two days on the contempt of court charge, the court had ordered his release on general date, directing body concerned to get photocopies of citizenship certificate and academic certificates of CJ Parajuli. The court has also sought details about the court verdict delivered by a bench involving CJ Parajuli about the reinstatement of IoM Dean Shashi Sharma.

KATHMANDU, Jan 12: The Nepal Bar Association (NBA) has drawn its attention on the activities of Dr Govinda KC of blaming the judiciary and using unethical terminologies targeting the particular justice.

The meeting of the NBA Friday concluded that such activities of Dr KC were defaming the public respect to a free and accountable judiciary.

The press statement issued by the NBA General Secretary Khamba Bahadur Khati has stated that a wrong trend could exist if such activities continued.

The trend of staging on hunger strike, demanding resignation of justices if the court decision failed to favour someone’s vested interest was wrong, press statement reads.

There are legal institutions to ensure legal remedies if required therefore, undue pressure to the judiciary was against the spirit of law, the press statement reads further.

The NBA has urged Dr KC to withdraw his decision of continuing hunger strike. RSS

RUKUM, Jan 12: Chief Justice Gopal Prasad Parajuli has said that he has already responded to the Parliamentary Hearing Special Committee (PHSC) regarding the questions raised about his citizenship and certificate of academic qualifications.

Inaugurating the District Court in Rukum (East) on Friday, CJ Parajuli said that nothing will happen by making unnecessary cries from the road. He also added that he joined the judiciary and was picked as the Chief Justice by being capable.

“I have already submitted the evidences in the required institutions. It is not necessary to exhibit the evidences on the roads,” the CJ said.

CJ Parajuli further said that it would not be possible as some forces were working to belittle the trust towards the judiciary under different pretexts.

Saying that the Judges move ahead based on people’s aspirations, legal norms and values, and system, CJ Parajuli directed the District Court to follow the same system in the days to come ahead as well. RSS

KATHMANDU, Jan 11: Orthopaedic surgeon at the Tribhuvan University Teaching Hospital Prof Dr Govinda KC has decided to continue his fast-unto-death.

Issuing a press statement here today, Dr KC, who was released on a general date by the Supreme Court on a case of contempt of court on Wednesday, said that the hunger strike will continue until his demands are met. “I will continue my struggle until the remaining demands in the purification campaign of the medical education and judiciary are met,” reads the statement.

Dr KC had begun his 14th fast-unto-death on Monday after the apex court decided to reinstate Dr Shashi Sharma as the Dean of TU, Institute of Medicine.

KATHMANDU, Jan 10: The Supreme Court has issued an order to bring a copy of both the citizenship certificates of Chief Justice Gopal Parajuli and also his academic credentials.

The division bench of Justices Pursottam Bhandari and Bam Kumar Shrestha issued the order on Wednesday following a hearing in a case of contempt of court filed against TUTH Orthopaedic Dr Govinda KC. The court has also sought a copy of the decision taken by the Judicial Council in relation to a case concerning the age of the CJ, including copies of the two citizenship certificates that he acquired from the Kathmandu District Administration.

Dr KC had raised questions over the citizenship certificates and academic accreditation of the Chief Justice while recording his statement today. Furthermore, the order calls for submission of the files of the verdict issued earlier with the involvement of the CJ in reinstating Prof Dr Sashi Sharma as the Dean of TU, Institute of Medicine.

It may be noted that Dr KC was released on a general date following the hearing. A case of contempt of court had been filed against Dr KC after he began a hunger strike demanding the resignation of CJ Parajuli, who had reinstated Prof Sharma to the post of IOM Dean.

Dr KC was then arrested as per an order of the court and presented before it on Tuesday morning. The hearing was completed for today and the next has been scheduled for February 20.

Senior advocates Shyam Kharel, Raman Kumar Shrestha, Kumar Regmi and advocates Tika Bahadur Hamal, Shiva Prasad Rijal, Madhav Kumar Basnet, Shiva Kumar Yadav, Shova Karki and others had pleaded on behalf of the petitioner.

Likewise, defending Dr KC in the case were senior advocates Dr Surendra Bhandari, Dinesh Tripathi, Ekraj Bhandari, Gopal Siwakoti and advocates Bijaya Mishra, Om Prasad Aryal, Indra Aryal among others.

In his statement following the order, Dr KC said that his struggle for justice would continue. “I will continue to fight until the Chief Justice resigns,” he said. RSS

KATHMANDU, Jan 9: Prof Dr Govinda KC was taken to Bir Hospital for treatment after he suffered a health problem on his way back after recording his statement at the Supreme Court today.

He had been experiencing complications since the afternoon including a low blood pressure, Dr Tosima Karki, his aide said.

Meanwhile, the apex court has ordered the police administration to ensure a facilitated stay for Dr KC, considering his health condition. The division bench of Om Prakash Mishra and Kedar Prasad Chalise issued the order, while also asking him to be presented before the court again at 10: am tomorrow.

KATHMANDU, Jan 8: Police have arrested senior orthopaedic surgeon of Tribhuvan University Teaching Hospital (TUTH), Prof Dr Govinda KC on Monday.

Metropolis Police Range Kathmandu Spokesperson Ram Dutta Joshi said that police arrested Prof Dr KC from his hunger strike site, TUTH in Maharajgung.

Dr KC has begun his 14th hunger strike from today demanding resignation of the Chief Justice after the Supreme Court issued an order to reinstate Dr Shashi Sharma as the dean at Institute of Medicine (IoM) on Sunday. He had also accused CJ Parajuli of being corrupt and having links with medical mafia.

Dr KC has been kept at Metropolitan Police Circle Singha Durbar.

Following which, a single bench of justice Dambar Bahadur Shahi on Monday had issued an order in the name of Home Ministry and Nepal Police Headquarters to make Dr KC present at the apex court over a case of contempt of court on Tuesday morning.

KATHMANDU, Oct 11: Prof Dr Gobinda KC has lamented over what he called the ‘disappearance of justice from the judiciary’.

Talking to media persons at the TU Teaching Hospital, Maharajgunj on Wednesday, Dr KC also warned of launching a protest as a civilian to retain judiciary’s dignity. Dr KC is on his eighth day of his 13th fast-unto-death demanding reforms in the medical education sector.

“If judiciary is without justice, where will the ordinary people go to seek justice”? It is the responsibility of all Nepali people to fight against this situation,” he said.

He expressed discontent over the release of Director General of Nepal Oil Corporation Gopal Khadka who was accused of misappropriating millions of rupees while procuring land for building fuel storage facility in different parts of the country. Dr KC also accused political parties and their leaders of corrupting states bodies.

He demanded that the Medical Education Bill be endorsed within October 21 before the term of the current Parliament expires. No response to this effect has come in from the government side so far however, he said.

KATHMANDU, Aug 9: Dr Govinda KC’s health condition continues to deteriorate fast as his 11th fast-unto-death enters 17th day on Wednesday. He has been provided with emergency services and he might need emergency medical intervention if his condition continues to worsen, according to doctors.

And yet, talk between the government and Dr KC’s team is not making any headway. Several meetings have been held between the government’s team headed by Education Secretary Shanta Bahadur Shrestha and the KC’s representatives-only failing to reach a concrete understanding.

Meanwhile, the Government Doctors’ Association of Nepal (GDAoN)has also launched a strike in support of Dr KC accusing the government of not taking any of the demands seriously. The doctors associated with GDAoN across the country have worn black armband boycotting all services expect attending to emergency patients.

The talks seems to have been stuck over one of the key demands of Dr KC is endorsement of the Health Profession Education bill which aims at imposing a 10-year moratorium in establishment of new medical colleges in Kathmandu Valley, which has not gone well with some lawmakers at the parliament.

The bill has been in the parliament since September last year. But there seems to have been an agreement to grant affiliation to medical colleges that meet the criteria before imposing the 10-year ban.

KC’s other demands include cutting fees of post graduate studies in medicine from NRS 3.1 million to 2.2 million and investigating into the irregularities of TU officials and taking action against them.
