SC orders CIAA to furnish files against Sharma from Special court

KATHMANDU, July 23: The Supreme Court has ordered Commission for Investigation of Abuse of Authority (CIAA) to present dossier for hearing on the writ petition filed against the alleged illegal detention of Director General of Inland Revenue Department Chudamani Sharma from the Special court.

An extended full bench of Justices Dipak Raj Joshi, Dipak Kumar Karki, Kedar Prasad Chalise, Sharada Prasad Ghimire and Anil Kumar Sinha issued the order in response to the habeas corpus writ filed by Sharma’s spouse Kalpana Upreti on July 11, according to co-spokesperson of the court Biswaraj Poudel.

A decision was also reached to seek the dossier of the related case underway at the special court.

A joint bench of Justices Cholendra Shumsher JB Rana and Prakash Raut on June 18 had issued an order to keep the case at the Special Court in status quo, and send it to a full bench.

Sharma is presently under judicial custody while a case of corruption against him is being tried at the Special court.

CIAA filed case against Sharma and two other officials-Lumba Dhwoj Mahat, the chairman of the Tax Settlement Commission and Umesh Dhakal, a member of the commission at the Special court last week claiming that the trio embezzled 10.96 billion rupees from state fund.

A team of CIAA on June 3 had arrested Sharma on charge of misappropriating revenue and settling taxes while Mahat and Dhakal are still at large.
